Defendant shall be punished by a fine of one million won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

No general restaurant business operator shall allow any person who runs the amusement business affecting the public morals under the Act on the Regulation of Amusement Businesses Affecting the Public Morals, to perform any act of obscenity, or mediate or providing such act at a place which conducts the amusement business affecting

Nevertheless, the Defendant, from November 18, 2013, opened a general restaurant in Gangnam-gu Seoul, with the trade name "C" in Gangnam-gu, Seoul, for the purpose of opening a website that recruits members with D's d'dithm and mathm (sM) tendency on the Internet, and sold jus, beer, beer, and beer, etc. to the said members while arranging or providing the act of SM inclination, etc. within the said establishment.

1. 피고인은 2014. 1. 초순경 위 업소에서 남자회원으로부터 5만 원, 여자회원으로부터 3만 원의 입장료를 받고, 위 업소 중앙에 마련된 무대 위에서 불상의 남자 회원으로 하여금 팬티차림으로 단상에 엎드려 불상의 여성 회원의 구두를 혀로 핥고 여성회원으로부터 회초리로 맞는 행위 등을 하게 하는 장소를 제공해 주어 위 업소를 찾은 남성회원, 여성회원들에게 음란행위를 제공ㆍ알선하였다.

2. 피고인은 2014. 12. 20.경 위 업소에서 회원으로부터 10만 원의 입장료를 받고, 위 업소 중앙에 마련된 무대 위에서 불상의 남자회원이 팬티 차림으로 단상에 엎드려 불상의 여성 회원의 구두를 혀로 핥고, 자신의 성기를 손으로 잡고 흔들어 발기시키는 행위, 여성회원이 남성회원의 머리채를 붙잡고 자신의 음부에 가져다 대고 남성회원은 여성회원의 허벅지를 혀로 핥는 행위, 여성회원의 가슴을 남성회원이 빨고 여성회원은 남성회원의 항문에 오일 바른 손을 집어넣는 행위 등을 하게 하는 장소를 제공해 주어 위 업소를 찾은 남성회원, 여성회원들에게 음란행위를 제공ㆍ알선하였다.
