Punishment of the crime

[2014 Highest 2416]

1. On January 13, 2014, at the D convenience store located in Daegu-gu, Daegu-gu, the Defendant: (a) stated that “The victim E, an employee of the said convenience store, has a site for the sports soil of the head of several thousands of which he/she had worked in advance and demanded the right to purchase; (b) issued a lottery ticket; and (c) issued a lottery ticket; and (d) stated that “The head of the Kafin who is the president of the Kafin adjacent to the convenience store, who is well aware of that he/she would have a shortage of money, with a total of KRW 90,000,000,000 with nine copies of the sports soil lottery ticket

2. On January 18, 2014, at G convenience stores located in Daegu-gu, Daegu-gu, around 2014.20:50, the Defendant: (a) opened a sports earth site for the sports territory of the head of several hundred and sixtys of which the victim, who is an employee of the said convenience store, was able to engage in the issuance of lottery tickets; (b) opened the issuance of lottery tickets; and (c) took care of the victim; and (d) cut off the Plaintiff with a total of KRW 16,00,000 from the victim, after receiving a total of KRW 16,00,000 from the victim.

3. 피고인은 2014. 2. 04. 16:30경 대구 북구 I에 있는 J 편의점에서, 위 편의점 직원인 피해자 K에게 미리 마킹하여 소지하고 있던 수십 장의 스포츠토토 용지를 건네주며 발권을 요구한 후 피해자가 복권 발급을 시작하자 말을 건네며 주의를 돌린 후, “번호를 확인 좀 하자”라고 말을 하면서 피해자로부터 합계 80만 원 상당의 스포츠토토 복권 8장을 건네받아 기간이 지난 복권 8장과 바꿔치기한 후 “돈을 깜빡하고 가지고 오지 않았다”라고 말을 하고 그대로 가지고 가 절취하였다.

[2015 Highest 541] On November 24, 2014, the Defendant demanded the victim N (n, 20 years of age) who was an employee at the M convenience store located in Daegu Suwon-gu L to set up a lottery site for the head of 20,000 won and to issue a ticket to the victim.
