A defendant shall be punished by imprisonment for three years.

However, the execution of the above punishment shall be suspended for five years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant, a foreigner of Sri Lankan nationality, entered the Republic of Korea as a non-professional employment visa (E-9) around 2008, and worked in B and C around that time, and served in E from around 2017 to around 2017.

From around August 21, 2019, the Defendant, from around 21:00 to around August 21, 2019, performed drinking, together with the victim F (F, 28 years of age, Sri Lankan nationality, hereinafter “victim F”), victim G (G, 34 years of age, Sri Lankan nationality, hereinafter “victim G”) and the working hours of Sri Lankan nationality, including the victim F (hereinafter “victim F”).

The Defendant discussed to the effect that, at the same time and at the same place, the Defendant had talked about the crackdown on illegal aliens, along with the work charges of Sri Lankan nationality, including the victims, “at the time of crackdown at the Immigration and Entry Office, it shall not help the illegal aliens pay for the illegal aliens.” As a result, the Defendant attempted to murder the victims, after hearing that the work charges, including the victims, were in a dispute with the work charges, which were illegal aliens, were in a nearby position.

On August 2, 2019, at around 02:37, the Defendant entered a kitchen (30cm in total length, 18cm in length) located in the nearby container accommodation with a kitchen located in the third floor of the said E dormitory, and entered the same nearby container accommodation at around 03:00 on the same day, the Defendant used the kitchen gate and approach the future to the instant E dormitory 1st floor restaurant of the victims.

On August 2, 2019, at around 03:14, the Defendant got in front of the restaurant of the first floor of the E dormitory in question, and made the surrounding area clear, made the victim F by the kitchen in the above kitchen, and made the victim F by the kitchen in the above kitchen knife, sound the above kitchen knife in a length of about 14 cm with the left part of the kitchen, sound the left part of the chest in a length of about 6 cm with a length of about 6 cm, and continuously try to stop the victim F from using the kitchen knife.
