Defendant shall be punished by a fine of KRW 5,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

[2015 high-speed 877] Fraud, around 13:00 on July 27, 2014, the Defendant made a false statement to the victim C, “Abreging KRW 100,000,00,00 to be used rapidly.”

However, even if the defendant borrowed the above money from the victim, the defendant did not have the intention or ability to pay it.

As such, the Defendant, by deceiving the victim, received KRW 100,00 from the victim in the same place, and acquired it by fraud.

[2015 high-level 878] On January 23, 2011, the Defendant made a false statement to the effect that “the victim E may work for the inter-scoping hours at home,” and that “I will work as an employee from the FC of the operation of the complainant after the date, if I lend 1.5 million won to the victim E as I need school expenses for the inter-scoping under family circumstances.”

However, even if the defendant receives a prepaid payment from the victim, he/she did not have the intention or ability to work as an employee in the multilateral management of the victim.

As such, the Defendant, by deceiving the victim, received 100,000 won in cash from the victim, and acquired 90,000 won in total from the agricultural bank account of G (H) designated by the Defendant, and 50,000 won in total from the agricultural bank account of I (J).

[2015Gohap879] On March 3, 2011, the Defendant made a false statement to the victim in Mda operated by the victim L in the Dong-dong, Gwangjubuk-gu, Seoul, stating that “The Defendant will pay half of the revenues every day from March 5, 2011 to April 3, 2011, while working for the victim from March 5, 2011 to April 21:00, he/she will pay half of the revenues.” On the same day, the Defendant received two million won from the victim in Mda as a prepaid payment. On the same day, the Defendant continued to obtain two million won from the victim as a prepaid payment and continued to live together with his/her male-gu, thereby lending 50,000 won to him/her, even if he/she had no money.”
