Reasons
1. The issues of the instant case and the judgment of the court of first instance
A. On May 10, 2012, the key issue of the instant case was the disposition revoking the Plaintiff’s driver’s license (hereinafter “instant disposition”) on the ground that the Plaintiff constituted “cases where the Plaintiff did not take necessary measures or report under Article 54(1) or (2) after killing or injuring a person due to a traffic accident” as prescribed by Article 93(1)6 of the Road Traffic Act.
The key issue of the instant case is ① Whether the Plaintiff did not take necessary measures or report under Article 54(1) or (2) of the Road Traffic Act after killing or injuring a person due to a traffic accident; ② whether the instant disposition revoking the Plaintiff’s driver’s license for the said reason was in violation of the law of deviation or abuse of discretion.
B. With respect to the issue ①, the first instance court's judgment at the first instance court held that the Plaintiff was an insurance company after the accident in this case, and left the scene without verifying the victims' status. They did not take relief measures against the victims except in this case where they were under the influence of alcohol at the time, and they did not inform the victims of the Plaintiff's personal information or their personal information. The victim was aware of the Plaintiff's personal information through the police officer on the day after the accident occurred, the police officer was reported to the scene of the accident, and the police officer did not inform the passengers of the Plaintiff's personal information even though the Plaintiff had already left the site, and the police officer did not promptly return to the scene of the accident while receiving the Plaintiff's contact with the Plaintiff through the employees of the insurance company. However, the police officer did not immediately return to the scene of the accident after the accident after the lapse of the accident.
