Reasons
1. Summary of grounds for appeal (unfair sentencing)
A. In light of all the circumstances, including the fact that Defendant B is against the Defendant, the sentence imposed by the lower court (one year and six months of imprisonment) is too unreasonable.
B. In light of all the circumstances, including the fact that the public prosecutor’s damage was not completely recovered from the crime of this case, and the fact that the defendant B was tried to commit the crime of this case while being tried to commit the crime of this case in connection with the crime of this case, the punishment of imprisonment [one year of imprisonment (two years of imprisonment) and one year and six months of imprisonment (three years of imprisonment)] imposed by the court below is too unreasonable.
2. Determination
A. According to the prosecutor’s assertion of unfair sentencing by the prosecutor on the defendant A’s assertion of unfair sentencing, the crime of this case is the prosecutor’s assertion that the defendant A should be punished strictly according to the following: (a) the defendant conspired with the defendant B to purchase the above soil owned by the victim E-friendly association; and (b) the defendant filed a lawsuit to execute the procedure for the registration of ownership transfer, and completed the registration of ownership transfer under his own name after obtaining a favorable judgment by winning a lawsuit; (c) the crime of this case by deceiving the court, which is a judicial institution, thereby deceiving the land of this case; and (d) the crime of this case requires strict punishment due
However, in full view of all the circumstances that are the conditions for the sentencing of this case, including the Defendant’s age, character and conduct, environment, motive and circumstance leading to the instant crime, and circumstances before and after the instant crime, etc., the lower court’s punishment is adequate and too unreasonable, and thus, does not seem to be unreasonable. In so doing, it is so by the Prosecutor.
