1. The Defendant: (a) out of the 96m2 of the C cemetery in Sosan City, the Plaintiff:
A. Each point of 10, 11, 8, 9, and 10 indicated in the attached Form.
Reasons
1. Basic facts
A. On March 15, 1985, the Plaintiff-owned land completed registration of preservation of ownership as to C cemetery 96 square meters (hereinafter “instant land”).
B. 1) D on July 29, 1995, adjacent to the instant land, 635 square meters in the E warehouse site (hereinafter “instant adjacent land”) shall be the following:
(C) On July 20, 1995, D completed the registration of ownership transfer on the grounds of sale as of July 20, 1995. Since then D around August 8, 1996, D is a warehouse listed in attached Table 1 (hereinafter “the instant brick warehouse”).
(2) Around September 18, 1996, G General Partnership (hereinafter referred to as “G”) constructed a warehouse in attached Table 2 (hereinafter referred to as “instant cement block warehouse”) on the adjacent land of this case and completed the registration of ownership preservation on October 10, 1996 after obtaining approval for the use of the instant brick warehouse. After that, as the compulsory auction procedure has been initiated with respect to the instant adjacent land and the instant brick structure, F had completed the registration of ownership transfer on January 22, 2003 on the ground of the successful bid for compulsory sale by official auction as of January 10, 203.
3) Since October 14, 2010, the Defendant purchased the adjacent land of this case and the brick storage of this case from G, and each of the cement block warehouses from G, and thereafter owned it until now since the completion of each registration of ownership transfer on October 15, 2010. 4) Meanwhile, on the adjoining land of this case, there exists a warehouse of the roof of the assembly-type panel (hereinafter “the assembly-type warehouse of this case”), which is unregistered, on the ground of the adjoining land of this case. The present owner is the Defendant.
C. (1) As of the present status of the instant land and the possession relationship, etc., 1) part (A) and 59 square meters in the ship connecting each point of the instant land in sequence of indication 1, 2, 3, 4, 12, 11, 10, and 1 of the annexed drawings among the instant land (hereinafter “instant case”).
