1. The Defendant’s KRW 380,000,000 as well as 5% per annum from November 8, 2014 to June 9, 2017 to the Plaintiff.
Reasons
1. Basic facts
A. The real estate listed in the separate sheet Nos. 1 through 8, 10 through 18, 20, 21, and 23 among the real estate listed in the separate sheet (hereinafter referred to as "D sale land") was collectively named, and the real estate listed in the separate sheet was owned by D when an individual real estate among the real estate listed in the separate sheet was collectively named. As for the real estate of this case 1 and 16 among them, the registration of ownership transfer was completed on June 23, 1998 for the real estate of this case 1 and 16, and on May 20, 198 for the remaining real estate, on the same day for the defendant, on May 20, 1998.
B. The defendant completed the registration of ownership transfer on August 2004 with respect to the real estate of this case among the real estate of this case 1 and 16 registered in the future E among D sale land, and on January 21, 2000 with respect to the real estate of this case 16, each defendant has completed the registration of ownership transfer based on sale in the future.
C. The instant real estate 9 was owned by F. On January 21, 2000, the registration of ownership transfer was completed on December 27, 1999 in the Defendant’s future. The instant real estate 19 was owned by G type. On December 17, 2008, the registration of ownership transfer was completed on November 16, 2008 in the Defendant’s future.
On March 21, 2002, the registration of preservation of ownership was completed on the instant 22 real estate, which was a building newly constructed on the ground of the instant 21 real estate. On August 13, 2004, the registration of preservation of ownership was completed on the instant 24 real estate, which was a building newly constructed on the ground of the instant 23 real estate. The Defendant resided in the instant 24 real estate, a house, from the time of the construction of the instant 24 real estate.
E. Meanwhile, from around 1984, the Plaintiff and the Defendant had a de facto marital relationship with the Defendant, and the Plaintiff, who was a public official, was living together with his residence in Seoul and the said house from around 2007 when retired from public office. From June 2014, the Defendant was living together with the Plaintiff, and was de facto marital relationship with the Plaintiff.
