1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

Facts of recognition

V and W shared the instant land in the proportion of 2/5 shares and 3/5 shares, regardless of whether before or after the division, they were divided into the real estate listed in paragraph (1) and paragraph (2) of the attached Table 1 of the 2/5 shares in the 1949 X-gun, X-gun, 1197 (the instant land was divided into the real estate listed in paragraph (1) of the attached Table 1 of June 27, 2003; hereinafter the same shall apply).

Y The Z acquired shares of 12/35 died, and Y(the decedents of the Defendant) and AA completed the registration of ownership transfer of shares and 2/35 shares in the instant land due to inheritance on May 25, 1966.

AA whose father AB’s 2/35 shares was acquired on September 26, 1966, sold the above 2/35 shares to AC, and completed the registration of ownership transfer on September 27, 1966.

AC sold the above 2/35 shares to AD on December 13, 1966, and completed the registration of ownership transfer on March 29, 1967.

AD sold the above 2/35 shares to AE on November 6, 1967, and completed the registration of ownership transfer on November 10, 1967.

AE sold the above 2/35 shares to AB (the father of the plaintiff) on December 1, 1969, and completed the registration of ownership transfer on December 31, 1969.

W, on January 5, 1955, the Plaintiff’s father AB’s 3/5 shares acquired, sold 3/5 shares out of the instant land to AF, and completed the registration of ownership transfer on April 13, 1956.

AF sold the above 3/5 shares to AG on November 20, 1959, and completed the registration of ownership transfer on January 15, 1960.

AG sold the above 3/5 shares to AH on March 30, 1971, and completed the registration of ownership transfer on April 9, 1971.

AH sold the above 3/5 shares to AB on December 29, 1972, and completed the registration of ownership transfer on December 30, 1972.

AB’s donation to the Plaintiff on April 10, 208, donated 23/35 shares (2/35 shares) of the instant land owned by the Plaintiff at the time of the Plaintiff, a ASEAN on April 10, 2008, and completed the registration of ownership transfer on April 15, 2008.

From 1972, AB has occupied and cultivated the entire land of this case from around 1972. At present, the Plaintiff occupies and cultivates the land of this case.
