A defendant shall be punished by imprisonment for one year.

Punishment of the crime

1. "2019 Highest 1776";

A. On August 23, 2018, the Defendant: (a) provided that “B is a director of LAA; (b) can use a siren A6 car for one year by sirening it to 15 million won; and (c) would return the full amount of the deposit upon the termination of LAC; and (d) made a false statement as if he/she would ensure the use of LA car; and (c) normally return rental deposit.”

However, at the time, the Defendant paid the rental fee for each month to the rental car proprietor, and again lent the rental vehicle to the Defendant’s customers, the Defendant was not the employee of C, and the Defendant was not the employee of C, and it was thought that the deposit received from the victim was used for the use of the rental fee for the rental car business operator or the deposit for other customers (so-called “so-called “defacing”) due to the failure to refund the rental deposit for the large number of customers other than the victim, and there was no other special property. Accordingly, if the rental is terminated, the Defendant did not have any intent or ability to return the rental deposit to the victim.

The Defendant, as above, by deceiving the victim, received KRW 15 million from the victim to the D account under the name of the Defendant.

B. Around October 24, 2018, the Defendant committed a crime against the victim E, stating that “B” is a person operating “B” to the victim in “G” operated by the victim E in Pyeongtaek-siF. The Defendant provided that K5 automobiles are sirened with a siren deposit of KRW 10 million so that they can be used for one year, and that the total amount of the deposit will be returned upon the termination of the siren,” and that the Defendant provided a false statement as if he/she would ensure the use of the siren vehicle and return the siren deposit normally.
