A is the representative of the B farming and B farming and the defendant B is a corporation that imports stove seeds necessary for mushroom growing from China, and cultivates and sells stove mushrooms.

Any person who intends to import goods, shall file a declaration thereon with the head of any customhouse on the name, standard, quantity and price of the relevant goods and other matters as prescribed by the Presidential Decree, and in this case, he shall not file a false declaration on a dutiable value

Nevertheless, on June 12, 2012, Defendant A evaded KRW 42,1616,590 equivalent to USD 485,407 in total, from the time of evading customs duties equivalent to USD 12,750, which is the difference by filing an import clearance after filing an import declaration of USD 15,570, even though the actual market price was USD 15,570,000, which is the difference between USD 12,750 and USD 964, and Defendant A evaded customs duties equivalent to USD 485,40 in total until July 9, 2014, as shown in the attached list of crimes. Defendant B’s farming association failed to prevent the aforementioned act in advance, which is the representative from October 10, 2013 to July 9, 2014, as in the attached list of crimes.
