1. The defendant shall obtain from the plaintiff the procedure for the registration of ownership transfer regarding the land listed in the attached list.
Reasons
Basic Facts
On October 27, 2005, the Plaintiff entered into a sales contract with the Defendant with respect to the purchase price of KRW 107,000,000 for KRW 2,846 square meters (the size was 2,759 square meters on March 8, 2006, and was divided into each land listed in the separate sheet on June 26, 2006; hereinafter “instant land”).
The sales contract of this case is written by the buyer as “the plaintiff and two others.”
Matters of special agreement
1. Where it is impossible to obtain permission for development activities and permission for diversion of farmland, a principal contract shall be cancelled, and the seller shall return the down payment to the buyer;
When a purchaser obtains a building permit, he/she shall obtain the consent of the seller from the related prop so that he/she can use the road (farmland infrastructure) when he/she obtains a building permit.
2. The seller shall install the access road (four meters wide) in the direction of D (in this case, the seller shall purchase the land and use it in the name of the buyer);
4. Permission for development activities and permission for diversion of farmland (including partition of lots) in the name of a seller; and the following expenses shall be borne by the purchaser and then the purchaser shall transfer the same name of the permission for development activities, etc. to the purchaser after the remainder payment.
On October 27, 2005, the date of the conclusion of the instant sales contract, the Plaintiff paid the Defendant the down payment of KRW 10,000,000,000, and thereafter, the Defendant set up the access road referred to in paragraph (2) of the said sales contract in the direction D to Pyeongtaek-gun, Gangwon-do. However, as the Plaintiff did not do so, agreed to reduce the remainder amount of KRW 7,00,000 in consultation with the Plaintiff.
Accordingly, on December 6, 2005, the Plaintiff paid 90,000,000 won to the Defendant.
On December 9, 2005, the Plaintiff received the registration of ownership transfer with respect to the instant land from the Defendant.
