Defendant shall be punished by a fine of KRW 1,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

On April 29, 2014, the Defendant destroyed the instant orchard owned by the Defendant in Jeju-si, as a result of the actual survey, on the ground that the boundary of an orchard owned by the neighboring victim D was invaded into an orchard owned by the Defendant, the Defendant destroyed the instant orchard with approximately KRW 85 million at the market price of the victim’s assertion, including approximately KRW 30 years of the receipt of KRW 85,00,000 from the victim’s 30-year amount of 30,000,000 won.

According to each of the above evidence, ① through a cadastral construction boundary survey conducted around March 30, 209, the victim’s trees, which were planted for the purpose of the protection and boundary marking between the neighboring water source and the water source owned by the victim, are found to be in the location of the victim’s owned water source. ② Accordingly, when the defendant demanded the victim to adjust the boundary, the victim would exchange the boundary with each other’s land and adjust the boundary to the right line with the victim’s land, and to look at the tree and fluor, etc., which was established on the land owned by the defendant, and eventually, consultation on the boundary line in exchange for the above land was not concluded, and as a result, the victim did not respond to the request by the victim for the adjustment of the boundary line to the victim’s water source. ③ The defendant did not mention that “the victim did not have been able to use the land at the time of 2014.”
