피고인은 B 제네 시스 승용차의 운전자인바, 2009. 12. 14. 부산지방법원에서 도로 교통법위반( 음주 운전) 죄로 벌금 200만원의, 2011. 8. 31. 같은 법원에서 도로 교통법위반( 음주 측정거부) 죄로 벌금 500만원의 각 약식명령을 발령 받았음에도, 2017. 4. 16. 00:10 경 혈 중 알콜 농도 0.155% 의 술에 취한 상태에서 부산 수영구 광안동에 있는 비치 그린아파트에서부터 같은 동에 있는 부성 팰리스 앞 노상까지 약 500m 가량 위 승용차를 운전하였다.
