원고는 2018. 3. 22. 23:50경 자전거를 타고 김천시 B 아파트 입구도로에서 위 아파트로 들어서는 순간 도로와 인도의 경계석 부근에서 자전거와 함께 앞으로 넘어지면서 몸이 튕겨나가 경계석 가장자리 대리석에 얼굴을 부딪치는 사고를 당하였다

On March 23, 2018, after the instant accident, the Plaintiff was at the C Hospital, but the hospital was in need of medical treatment, transferred to the G Hospital and was subject to non-alleylogic diagnosis on March 23, 2018. On March 26, 2018, the Plaintiff performed strokeic and anti-mecopic surgery at the foregoing hospital, and discharged on March 29, 2018. On April 5, 2018, the Plaintiff was diagnosed by strokeic and anti-meopic surgery at the Gan University Hospital, and performed the strokeic and anti-meopic treatment.

다. 원고가 이 사건 이후 이 사건 사고가 발행한 현장에 가서 확인한 결과 경계석 부근의 도로에 설치된 맨홀의 덮개가 뒤집어져 설치되어 있음을 확인하고, 2018. 4. 3. ‘우수라인 맨홀 뒤집어져 로드자전거 바퀴 빠지면서 전복되어 사람이 튕겨나가 앞 대리석에 안면 강타하여 4주 진단 발생됨’이라는 내용으로 신고하였고, 2018. 4. 11. 피고(건설안전국 도로철도과)로부터 민원에 대한 수용과 보험 등에 관한 안내를 받았다.

2. Occurrence of liability for damages;

A. We examine the determination on the circumstances of the instant accident, i.e., the following circumstances acknowledged by adding the aforementioned evidence and the witness witness D’s testimony to the overall purport of the pleadings, i.e., CCTV video where the form of the instant accident was taken, i.e., the Plaintiff’s own bicycle at the vicinity of the road between the instant apartment entrance and the India’s boundary.
