1. Basic facts

A. On May 8, 2013, Nonparty B Co., Ltd. (hereinafter “debtor”) received a decision on commencing rehabilitation procedures from the Seoul Central District Court 2013 Mahap85, and Defendant C was appointed as the custodian of the obligor’s company.

B. Around August 2013, the Defendant awarded a contract to Nonparty D Co., Ltd. (hereinafter referred to as “Nonindicted Company”) for the construction cost of KRW 1.555 billion (including value-added tax) and the construction period from August 26, 2013 to April 8, 2014, by setting the construction cost of KRW 1.55 billion (including value-added tax) among the “F New Construction Works” located in the “F New Construction Works” located in the Dong-si, Kimhae-si.
