A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

On January 2016, the Defendant made a false statement to the effect that “The Defendant: (a) newly built a hotel in the sea transport unit with the 33-year old-in-U.S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S.S. S. S. S. S.S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S.S. S. S. S. S. S. S

However, in fact, the Defendant had planned access from the beginning to acquire money from the damaged person, and the Defendant had a false statement that he newly constructed a hotel. Therefore, even if he received money from the injured person as a construction cost, he did not have the intention or ability to do the tegical construction.

The Defendant was transferred from the victim the KRW 10 million on February 3, 2016, KRW 5 million on February 12, 2016, KRW 100,000 on February 13, 2016, KRW 100,000 on February 13, 2016, and KRW 12 million on April 18, 2016 to the account in the name of Han Bank in the name of the Defendant, respectively.

Accordingly, the Defendant, by deceiving the victim, was given a total of KRW 28 million from the victim.
