1. On the Plaintiff (Counterclaim Defendant),

A. The Defendant (Counterclaim Plaintiff) Construction Co., Ltd. amounting to KRW 24,675,00 and this amount.

1. Basic facts

A. On July 2, 2009, the Plaintiff and the Aminos Co., Ltd. (hereinafter “Aminos”) entered into a construction supervision agreement with the Plaintiff on the contract amounting to KRW 350 million (hereinafter “the instant supervision agreement”) with respect to the new construction works of Plus A-1-1 New History (Research Institute) that the Plaintiff and Aminoss intend to newly construct in Plus-dong 616-1, Sungnam-gu, Sungnam-si (hereinafter “instant building”). The main contents are as follows.

The Plaintiff and the Defendant’s Information T&C are called “A” and “B”.

Article 7 (Commencement of Work) (1) "A" shall notify "B" of the commencement date three days prior to the commencement date, and "B" shall commence construction supervision from the commencement date.

Article 8 (Performance of Duties) (1) "B" shall confirm whether a building is constructed in conformity with the design documents and shall perform construction supervision according to the scale of the building according to the detailed standards for construction supervision, as prescribed by the relevant Acts and subordinate statutes.

(2) Where the construction work in question is not carried out in conformity with the design documents or is found to be in violation of the relevant Acts and subordinate statutes and the orders or dispositions thereunder, the “B” shall notify the construction executor thereof and then request the construction executor to correct or rebuild it.

(3) "B" shall confirm the result of a measure taken by the construction executor upon the request referred to in paragraph (2) and notify "A" thereof.

(4) If the construction executor fails to comply with the request referred to in paragraph (2), the term “B” may request the suspension of the construction work concerned.

(5) If a contractor fails to comply with a request for correction, re-execution or suspension of construction, "B" shall be notified to A after reporting it to the head of a Si/Gun/Gu.
