Defendant

A shall be punished by imprisonment with prison labor for ten months and by imprisonment for six months.

However, this decision is delivered to the Defendants.

Punishment of the crime

No person, other than Korea, shall act as an agent or intermediary to purchase marina tickets or similar for profit, or transfer marina tickets.

From March 2015 to October 25, 2015, Defendants: (a) provided a computer, etc. on the above loan 5-102 Dong-gu, Sincheon-gu; (b) paid KRW 1 million per week to the names in the name of operating the “D”, which is a private website; and (c) sold a horse purchase ticket to the customers from the server opened in the name of the Defendants with the database ID from the non-personally defective persons; and (d) provided a certain portion of the purchase price of the horse as the commission to the customers; (b) the customers received the horse information from the centers established in the private horse race track by D; and (c) the D Center received dividends through the system that provides the head office with the voting result; and (d) the D Center has the possibility of purchasing the horse from among the buyers purchased from the horse tickets.

In order to avoid the risk of the payment of dividends on the betting tickets, Defendant A, through a private horse program, shall take over the risks of the betting tickets on behalf of another center; Defendant B shall take advantage of the profits equivalent to the horse price purchased by the initial buyer after paying only a small amount of fee to the private horse terminal purchased by the initial buyer if the horse terminal is not string; and Defendant B shall take the responsibility of paying dividends to the buyer if the horse is string), and later, from October 23, 2015 to October 25, 2015, by receiving the purchase slip price from the head office according to the result of the customer’s voting; Defendant A shall take charge of the general management of the private horse site, such as the sale and settlement of the purchase price, and Defendant B shall inform customers of the purchase password by telephone, and Defendant B shall notify customers of the purchase password through the server.
