1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Basic facts

A. C is a person who was a de facto representative director of D Co., Ltd. (the defendant's trade name is changed, hereinafter referred to as "the defendant"), E was a representative director of the defendant on the registry due to C's fraud, and F is between the plaintiff and the land owner.

B. The Plaintiff decided to purchase approximately 500 square meters (hereinafter “instant real estate”) out of approximately 1/3 shares of G forest 19,586 square meters in G forest in Gwangju-si owned by the Defendant, the Defendant, and sold 250 square meters among them to F.

Accordingly, F paid to the Defendant the amount of KRW 5 million on July 13, 2001, and KRW 120 million on July 20, 2001, respectively.

C. On May 1, 2002, the Plaintiff entered into a sales contract with the Defendant to purchase the instant real estate at the purchase price of KRW 150 million (the contract amounting to KRW 40 million, KRW 10 million, KRW 100 million, KRW 100 million, KRW 100 million, KRW 30,000, KRW 1000, KRW 1000, KRW 1000, KRW 1000, KRW 1000, KRW 1000, KRW 200, KRW 300, KRW 300, KRW 300, KRW 200, KRW 400, KRW 400, KRW 1000, and KRW 30,000, KRW 203) (hereinafter “instant sales contract”).

G 19,586 square meters of H forest was subject to registration conversion into 19,854 square meters of H forest in Gwangju-si, and was divided into 2,965 square meters of forest and 16,889 square meters of forest and 11,923 square meters of forest and 3,306 square meters of J forest, 16,889 square meters of forest and 16,60 square meters of forest and 11,923 square meters of forest and 11,923 square meters of forest, 11,923 square meters of forest and 7,967 square meters of forest and 3,343 square meters of forest, M 4,572 square meters of forest and 41 square meters of forest, respectively.

H Forest land 2,965 square meters was divided into 2,715 square meters of H forest land and 250 square meters of O forest on March 17, 2010, and the said H forest was converted into 2,715 square meters of land for the same lot number on July 19, 2010.

E. Meanwhile, in addition to the instant sales contract in around 2008, F prepared a sales contract stating that the purchase price of KRW 125 million is KRW 125 million with respect to the purchase price of approximately 7,956 square meters of I Forest Land 7,956 square meters ( approximately 2,50 square meters) in B and Gwangju City, and that the said real estate subject to consultation purchased approximately 500 square meters with the Plaintiff, but entered into a separate contract with F.

F. C The Plaintiff’s guarantee between F and F on July 22, 2011.
