A defendant shall be punished by imprisonment with prison labor for up to six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On July 7, 2015, the Defendant posted on July 7, 2015, the language “F” on the Internet NAV’s bulletin board using the Defendant’s residence and cell phone located in Ulsan-gu, Ulsan-gu 101, the Defendant sent text messages to the victim G who reported and contacted, to sell the fishing age when remitting the proceeds of fishing.

However, since the defendant did not have a fishing age, even if he received money from the victim, he did not have the intent or ability to sell the fishing age to the victim.

The Defendant received 150,000 won from the victim’s account in the name of the Defendant at around 17:07 on the same day.

In addition, the Defendant received a total of KRW 2,135,00 from 13 victims in the same place from August 19, 2015, as shown in the annexed Table 1 list of crimes.

Accordingly, the defendant was informed of the victims and received property from the victims.

On August 17, 2015, the Defendant sent text messages to the victim, on the Internet NAV, using a cell phone from the Defendant’s residence located in Ulsan-gu Cwon room 101, Ulsan-gu, and from the Defendant’s workplace located in Ulsan-gu D, U.S., Nam-gu, U.S., to the bulletin board of the Internet NAVV “SER” page, and then sent text messages to sell them to the victim if the Defendant sent the above slot margin.

However, since the defendant did not have the above margin, even if he received money from the victim, he did not have the intention or ability to sell the above margin to the victim.

The Defendant received 40,000 won from the victim’s account in the name of the Defendant at around 09:26 on the same day.

In addition, from that time to August 24, 2015, the Defendant’s total sum of KRW 190,000 from four victims, such as the list of crimes in attached Table 2, at the same place.
