1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Details of the disposition;
(a) Plaintiff’s entry into the Republic of Korea and application for refugee recognition - Plaintiff’s nationality: entry into the South African Republic - On November 11, 2015, status of stay for tourism and Tong (B-2) (the expiration date of stay: December 11, 2015): Application for refugee status: November 20, 2015.
The defendant's decision not to recognize refugee status (hereinafter referred to as the "disposition of this case") - Grounds: No sufficient fear of persecution cannot be recognized.
C. The Plaintiff filed an objection with the Minister of Justice on December 30, 2016, but the Plaintiff’s ground for recognition was dismissed on April 21, 2017. The Plaintiff’s ground for recognition was without dispute, and the purport of the entire pleadings, as stated in Gap’s evidence Nos. 1, 2, and Eul’s evidence Nos. 1 through 4.
2. Whether the instant disposition is lawful
A. While the Plaintiff’s assertion was married from Pakistan and operated a mobile phone store in the South Africa Republic of South Africa in 2003 with women of the South Africa, on July 2015, the Plaintiff died by suffering a total of black strengths, in which South East East Africa possessed firearms on the road side, and thereafter, the Plaintiff was destroyed by blacks and the products were stolen. Accordingly, if the Plaintiff returned to the South Africa Republic of South Africa, it would be likely to be harmful to them.
(b) The definitions of terms used in this Act under relevant Acts and subordinate statutes shall be as follows:
1. The term "refugee" means a foreigner who is unable or does not want to be protected by the country of his/her nationality due to well-founded fear that he/she may be injured on the grounds of race, religion, nationality, status as a member of a particular social group, or political opinion, or a stateless foreigner who, owing to such fear, is unable or does not want to return to the country in which he/she resided before entering the Republic of Korea (hereinafter referred to as "state of his/her nationality");
C. “Lambling” which is a requirement for recognition of refugee status 1 is against the fundamental human dignity, including threats to life, body or freedom.
