A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

피고인은 2013. 1. 7. 23:00경 B 체어맨 승용차를 운전하여 광주 서구 마륵동에 있는 삼성디지털프라자 앞길을 세정아울렛 방면에서 서창입구 방면으로 편도 4차로 중 2차로를 이용하여 시속 60km의 속도로 진행하던 중 충분한 안전거리를 유지하고, 전방을 주시하여 사고를 미리 방지하여야 할 할 업무상 주의의무를 게을리 한 채 진행한 과실로 같은 방향 전방에서 신호대기를 위하여 정차 중이던 피해자 C(57세)이 운전하는 D 와이에프 쏘나타 개인택시의 좌측 뒤 펜더 부위를 위 체어맨 승용차의 우측 앞 펜더 부위로 충격하여 피해자에게 약 2주간의 치료를 요하는 경추 염좌 등의 상해를 입게 함과 동시에 피해차량 리어 범퍼 등을 수리비 1,154,996원 상당이 요하도록 손괴하였음에도 즉시 정차하여 피해를 확인하고 피해자의 구호 조치를 하여야 하는 등 필요한 조치를 하지 않고 도주하였다.
