1. The plaintiffs' claims against the defendants are all dismissed.
2. The costs of lawsuit are assessed against the plaintiffs.
Reasons
1. The gist of the Plaintiffs’ assertion is that the Plaintiffs agreed with Defendant FF farming association (hereinafter “Defendant F”) to receive allowances according to the fixed pay and performance of KRW 1.2 million per month, and were in charge of land sale. Defendant F’s representative director, Defendant H, and Defendant F’s auditor, as Defendant F’s auditor, jointly and severally guaranteed each of the Plaintiffs’ payment obligations.
Plaintiff
A is jointly and severally liable to pay the Defendants the total amount of fixed pay of KRW 20,40,000 for 17 months from January 1, 2014 to May 31, 2015, the total amount of fixed pay of KRW 16,80,000,000 for 14 months from April 1, 2014 to May 31, 2015, and Plaintiff C, for 16 months from February 1, 2014 to May 31, 2015, the total amount of fixed pay of KRW 19,20,000,000,000,000 for 13 months from May 1, 2014 to May 31, 2015, and Plaintiff D, from April 1, 2014 to May 1, 2015 to the Plaintiffs’ damages for delay from April 1, 2015 to May 16, 2015.
2. We examine whether Defendant F agreed to pay 1.2 million won as monthly fixed pay to the Plaintiffs, and whether Defendant G and H jointly and severally guaranteed Defendant F’s duty to pay wages.
According to the statements in Gap evidence 7 and 9 (including evidence attached with each number), the fact that the plaintiff received KRW 1,643,900 from defendant F for the purpose of March 21, 2014, and KRW 1,000,000 for the purpose of salary in January 6, 2015, KRW 500,00 for the purpose of salary in January 22, 2015, KRW 1,160,40 for the purpose of salary in February 1, 2015, KRW 1,643,90 for the purpose of salary in March 5, 2015, KRW 2,80 for the purpose of salary in March 1, 205, KRW 30 for the purpose of salary in March 1, 2015, KRW 1,643,90 for the purpose of salary in March 3, 2015, KRW 2,804,300 for the purpose of salary in April 16, 2013,2015.
