계속하여 피해자들의 일행들이 피고인, E의 폭행을 저지하고, 피해자들을 데리고 부근에 있는 ‘K’ 앞길로 도망가자 E이 뒤따라 와 손으로 피해자 H의 가슴을 2회 밀치고 주먹으로 얼굴을 3회 때려 바닥에 넘어뜨려 대리석에 부딪히게 하였고, 계속하여 E은 주먹으로 대리석에 부딪혀 쓰러져 있는 피해자 H의 몸에 올라 타 얼굴을 1회 때리고 발로 얼굴을 2회 찼다.
