The appeal is dismissed.
Reasons
The grounds of appeal are examined.
For the reasons indicated in its reasoning, the lower court reversed the first instance judgment that convicted the Defendant, and sentenced the Defendant not guilty, on the ground that there was no proof of crime regarding the facts charged in the instant case.
In light of the record, the lower court did not err by misapprehending the rules of evidence, while examining the record.
Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
