Criminal facts

Defendants are members of the Gyeonggi-do Private Taxi Transportation Business Association (hereinafter referred to as the “F private taxi business association”), and are those who support G appointed as the head of the F private taxi business association around November 2007.

G was passed at the meeting of the representatives of the above partnership on July 2, 2009, the resolution to dismiss the president of the above partnership from the office of the president of the above partnership, and the lawsuit was conducted after filing a lawsuit for confirmation of non-existence of the resolution of the representative general meeting of the Suwon District Court. However, on October 5, 2010, the military Saemaul Community Fund deposited KRW 91,766,108 as the principal deposit with the above partnership on the ground that it refuses to receive it through a dispute within the partnership's internal dispute, and on October 8, 2010, the Han Bank deposited KRW 91,057,810 as the principal deposit with the above partnership and deposited at the above court.

Accordingly, in order to enable G to receive the above deposit money, the Defendants prepared the meeting minutes of the board of directors containing the Defendants as directors together with G and solicited G to submit them to the said court.

The Defendants, on February 10, 201, prepared the meeting minutes of the board of directors stating that the Defendants, at the office of Gyeyang-gu, Mayang-gu, Busan-si, a private sector, held a board of directors with G as an agenda item for the appointment of a manager of the right to claim payment of deposit money (Military Saemaul Depository) at the office of the Associationyang-dong. The case of the manager of the right to claim payment of deposit money No. 2010, No. 4017 (Military Saemaul Depository), using a computer located therein, by explaining in detail the necessity of the appointment of the above representative (manager) and seeking a resolution thereon. As a result of the careful discussion of all the present directors, the minutes of the board of directors’ meeting stating that “The current representative (G) was to be elected as the manager of the right to claim payment of deposit money of the union.”
