Examining in accordance with the relevant legal principles and evidence duly admitted, the lower court did not err by exceeding the bounds of the principle of free evaluation of evidence against logical and empirical rules in determining guilty of the instant facts charged (excluding the part not guilty of the order), or by misapprehending the legal doctrine on the criminal intent, intentional act, intent of unlawful acquisition, etc. committed through deception in fraud.

In addition, even after examining the record, the court below did not err by giving the defendant an opportunity to make a final statement and an opportunity to make a statement.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
