피고인은 2015. 12. 10. 02:20 경 의정부시 C 소재 D 버스 정류장에서 같은 방향으로 가는 피해자 E( 여, 25세 )를 발견하고 F 버스에 함께 승차한 후 같은 날 03:20 경 동두천시 G 아파트 3 ㆍ 4 단지 버스 정류장에 이르러 술에 취하여 졸고 있는 피해자를 깨워 같이 하차한 다음, 귀가하는 피해자를 따라가 그 곳 인도 옆에 설치된 철조망에 피해자를 밀치고 통화를 하려는 피해자의 휴대폰을 빼앗아 반항하지 못하게 한 후 키스를 하고 몸을 밀착시켜 자신의 성기를 피해 자의 성기에 비볐으며 도망가는 피해자를 쫓아가 키스를 하고, 겁을 먹고 주저앉아 울고 있는 피해자를 바닥에 넘어뜨리고 피해자의 몸 위에 올라 타 피해자의 상의 안으로 양손을 집어넣어 피해자의 양쪽 가슴을 만져 피해자를 강제로 추행하고, 그로 인하여 피해자로 하여금 약 2 주간 치료가 필요한 우측 슬관절 좌상 등을 입게 하였다.
