A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On October 2, 2018, at around 16:50, the Defendant: (a) moved to the head of the passenger car operation line and moved to the coffee shop located in Yyang-gun, and (b) took charge of the victim’s losses by sudden hand; (c) even though the victim took away the victim’s losses, the Defendant took charge of the victim’s left side buckbucks; and (d) 17:53 on the same day, the Defendant took charge of the victim’s losses within the car moving to the restaurant located in F of the Y-gun-gun, the Defendant took charge of the victim’s losses.

이후 피고인은 같은 날 18:56경 광주 동구 G 모텔 주차장까지 이동하면서 다시 오른손으로 피해자의 손을 주무르고, 계속하여 피고인은 ‘G 모텔’ 주차장에 차를 정차한 후 “모텔을 잡아 줄 테니 여기서 자고 내일 아저씨랑 같이 순천으로 가자”고 했으나, 피해자가 거절하면서 차에서 내리자 피해자에게 “집에 데려다 줄테니 차에 다시 타”라고 하며 피해자를 다시 자신의 차 조수석에 태웠고, 같은 날 19:35경 담양군 H에 있는 I 인근으로 이동하면서 손으로 피해자의 손을 잡아끌어 만지고, 이에 피해자가 자신의 손을 빼고 팔짱을 껴 더 이상 손을 만지지 못하게 하자 “우리 한번 하자”고 말하며 오른손으로 피해자의 왼쪽 허벅지를 주물렀다.

Accordingly, the Defendant committed an indecent act on the part of the victim.
