The prosecutor's appeal is dismissed.

The defendant has been punished several times due to drinking or non-licensed driving, and again committed the crime of this case during the period of probation, and it is not easy that the nature of the crime is light in that the defendant escaped from the police officer who was under the control of drinking driving.

However, the defendant has no record of punishment as punishment, and has committed a crime in depth, and has not committed a second offense.

Defendant has provided a decent working life while supporting a bad elderly with health.

In addition, considering the age, character and conduct, environment, etc. of the defendant and all the sentencing conditions shown in the pleadings, it cannot be said that the sentence imposed by the court below is too uneasible and unfair.

3. In conclusion, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act as it is without merit. It is so decided as per Disposition.
