1. The defendant shall pay to the plaintiff the amount of KRW 108,926,031 and KRW 28,540,924 from April 20 to the date of full payment.

The judgment on the cause of the claim (However, the creditor is the plaintiff, the debtor is the defendant) is not in dispute between the parties, or can be recognized in full view of the purport of the entries and the whole arguments in the evidence Nos. 1 and 2, so the defendant is obligated to pay to the plaintiff damages for delay calculated at the rate of 17% per annum from April 20, 2016 to the day of full payment, which is the day following the final interest calculation, for the total amount of KRW 108,926,031 and the principal amount of KRW 28,540,924.

2. As to the defendant's defense, the defendant's defense to the effect that the plaintiff satisfied all the claims acquired by transfer, but there is no evidence to acknowledge it, and the defendant's defense is without merit.

Furthermore, the defendant's defense that the above claim of the plaintiff was extinguished by prescription. However, according to Gap's evidence No. 2, the plaintiff filed a lawsuit against the defendant against Busan District Court 2006Da33001 and received a favorable judgment on July 6, 2006, and it can be recognized that the above judgment became final and conclusive around that time. Since the lawsuit of this case was filed prior to the lapse of 10 years thereafter, the defendant's defense was therefore groundless.

3. The plaintiff's claim of this case is justified and it is so decided as per Disposition.
