The punishment of the accused shall be four months by imprisonment.

Punishment of the crime

On March 23, 2017, the Defendant was elected as the representative of the Dong Dong-dong, North-gu apartment B, North Korea-si, and on April 13, 2017, the Defendant was elected by obtaining 9 votes from the chairman of the council of occupants' representatives in the election of the above apartment unit E, the above apartment election commission decided the invalidation of the election on the ground that the Defendant entered the ballot book two times. On this matter, the Defendant filed a lawsuit seeking confirmation against the above apartment unit’s representative council in the Daegu District Court Branch on May 22, 2017, and was reinstated as the chairman of the council of occupants’ representatives after receiving a favorable judgment on November 23, 2017.

1. As of April 1, 2017, the Defendant had a good appraisal on the ground that the victim F, who had worked as the president of the above apartment complex integration management office, had been present and testified as a witness on the other party in the lawsuit for confirmation of the status of the president of the said tenant representative council filed by the Defendant.

Around 09:00 on December 19, 2017, the Defendant: (a) at the Integrated Management Office of the above apartment complex; (b) on November 14, 2017, the victim made a tender according to the decision of the council of occupants’ representatives on the part of November 14, 2017, which the victim decided to select cleaning service providers through electronic bidding; and (c) the Defendant did not arbitrarily made a tender; and (d) the Defendant was well aware of this fact at the council of occupants’ representatives, despite the fact that the Defendant was attending the said council of occupants’ representatives, the Defendant damaged the victim’s reputation by openly pointing out false facts.

2. The Defendant, as the president of the council of occupants' representatives of the above apartment complex, has been entrusted with general business affairs related to administrative affairs and management expenses for the whole occupant of the apartment complex, who is the victim.
