1. The defendant A shall be punished by imprisonment with prison labor for eight months and by imprisonment with prison labor for one year;
2.Provided, That this judgment has become final and conclusive.
Reasons
Punishment of the crime
1. Defendant A
A. On November 17, 2013, Defendant A purchased marijuana from the toilets located at the above “C” store on November 14, 2013, and offered to Defendant A a beer with approximately KRW 4,500 at the market price in return for the marijuana, for which the quantity cannot be known from Defendant B.
Accordingly, Defendant A traded marijuana.
B. At around 15:00 on November 17, 2013, Defendant A smoked, at the dormitory of E Co., Ltd., Ltd., Inc., Ltd., Inc., Ltd., D, less the dust in one cigarette, and then injected it by inserting the marijuana purchased as above and attaching a fire.
Accordingly, Defendant A smoked marijuana.
2. Defendant B
A. On November 17, 2013, Defendant B, at the top of “C” store in “C” located in “Shovah City F, E, and, in return, received from Defendant B a beer-in disease equivalent to KRW 4,500 in the market price.
Accordingly, Defendant B traded marijuana.
B. At around 18:00 on August 1, 2014, Defendant B, at H’s dormitory container located in Ansan-si, Seoul-si, a member G, reduced the dust in one cigarette, and then injected the smoke by inserting marijuana, with the amount of which cannot be known in the container.
Accordingly, Defendant B smoked marijuana.
C. At around 11:30 on November 4, 2014, Defendant B, who is in possession of marijuana for smoking purposes, indicated “3.44g of the bill of indictment for marijuana 30g at the container for the above dormitory,” but it is obvious that it is a clerical error.
