1. Based on the conjunctive claim added at the trial, the Defendants jointly and severally do so to the Plaintiff, as well as KRW 201,814,516.
Reasons
1. The cause of the claim and the scope of the judgment of this court;
A. In the first instance trial, the Plaintiff filed a request for the delivery of 1, 2, 3, and 4 of the real estate listed in the separate sheet against the Defendants (hereinafter “instant store”) and filed a joint payment of the following money:
(1) From May 2013 to April 2014, the monthly rent, management expenses (totaling KRW 650,760,00,000 that incurred up to April 1, 2014, and KRW 54,330,00 that incurred up to May 1, 2014) for public electricity, water supply fees, and KRW 7,391,360 for the instant store from May 1, 2013 to April 2014.
B. However, the court of the first instance dismissed the Plaintiff’s request for the delivery of the instant store, and dismissed all of the monetary claims against the Defendant junex Co., Ltd. (hereinafter “Defendant junex”), and rejected the claim against the Defendant junex Co., Ltd. (hereinafter “Defendant junex”), and rejected the claim for the remainder of KRW 506,411,613 (with respect to the instant store 1 and 2, KRW 303,131,613, which occurred until January 4, 2014, KRW 203,280,00 that occurred until April 2014, KRW 7,391,360, KRW 180, KRW 5000, KRW 5000, KRW 5000, KRW 5000, KRW 5000, KRW 5000, KRW 3 and 4 of the instant store.
C. As to this, only the Plaintiff filed an appeal and withdrawn the request for the delivery of the instant store at the trial, and as to the claim against the part of the first instance judgment against Defendant C&C, Defendant C&C filed a claim for KRW 273,259,674 of the sum of the following amounts on the ground of unjust enrichment, and as a preliminary claim, the conjunctively amended the purport of the claim to the Defendants by jointly and severally claiming the said amount on the ground of tort.
(1) On January 5, 2014, from January 5, 2014 to June 2014, KRW 218,929,387 equivalent to monthly rent, management fee, and KRW 218,929,387, and KRW 1, and two floors of the instant store.
