1. The plaintiff's appeal is dismissed.
2. The costs of appeal shall be borne by the Plaintiff.

Reasons
1. The reasoning of the judgment of the court of first instance citing this case is as follows, except where the plaintiff added 2.2. additional determination as to the assertion that the plaintiff emphasizes or added in this court, and thus, the reasoning of the judgment of the court of first instance citing this case is as stated in the main sentence of Article 420 of the Civil Procedure Act.
2. Additional determination
A. According to Article 8 of the Public Offering and Guidelines of this case and Article 24 of the Guidelines, etc. of this case, the plaintiff shall be deemed as a standardized contract under the Regulation of Standardized Contracts Act, and Article 8 of the Public Offering of this case and Article 24 of the Guidelines of this case impose an obligation to enter into a land sale contract and a business agreement on the applicant for a business who is selected as the subject of preferential bargaining, and impose any such obligation or sanction on the defendant, while the defendant does not impose any such obligation or sanction, and if there is no eligible business operator, the defendant may not select the subject of preferential bargaining. Thus, this constitutes a provision unreasonably unfavorable to the customer, which constitutes a provision that restricts fundamental rights under a contract to the extent that it is impossible to achieve the purpose of the contract, and thus, the plaintiff's assertion on the premise that the pertinent provision of the Public Offering and Guidelines of this case constitutes a clause that is contrary to the principle of trust and good faith or is null and void. Thus, even if it falls under a standardized contract, it is difficult to recognize that each of the above provisions is unfairly unfavorable to the customer.
B. In light of the language and text of Articles 4 and 24 of the instant Guidelines, or considering Article 5(1) of the Regulation of Standardized Contracts Act, the Defendant is objective criteria for the participants in the instant contracts, including the Plaintiff.
