A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
1. The criminal defendant committed fraud with intent to acquire money in the name of the price of goods from those who reported or contacted with the criminal defendant's sales of goods or those who posted a letter on the purchase of goods at the Internet goods trading site as if they could supply the goods.
On March 30, 2016, the Defendant: (a) PC room in Seodaemun-gu Seoul (hereinafter referred to as “Seomun-gu”); (b) reported on the victim’s Internet goods transaction site “I would purchase the Kakaio Masius’s visibility” and contacted the said victim; (c) deceiving the victim as if he had no intent or ability to sell the said goods; (d) received KRW 150,000 from the victim to the new bank account in the name of the Defendant’s name as the price for the goods on the same day; and (c) received KRW 1,609,500 in total from 13 victims by means of the same method as the list of crimes in the attached Table from February 20, 2017.
2. The Defendant, including computers, committed fraud with intent to purchase cultural merchandise coupons or game money by settling a small amount of money with his/her mobile phone without obtaining permission from persons who have known of his/her reputation.
A. From around 06:10 on August 28, 2016 to 06:27, the Defendant: (a) entered the victim’s information from the Plaintiff’s cell phone (E) to the Plaintiff’s cell phone (E) during the period in which the victim D, who performed drinking together, entered the victim’s information from the Plaintiff’s cell phone (E) and purchased cultural merchandise coupons, money, etc. worth KRW 520,000 on a total of 14 occasions.
Accordingly, the defendant, without authority, obtained property benefits equivalent to 520,000 won by inputting the information of the victim into the information processing device and making it processed.
B. The Defendant, from August 31, 2016 to 08:05, 07:00 to 08:05, is the victim F, who performed alcohol in the Eunpyeong-gu Seoul Metropolitan Non-Wide-Area Mourel, and together.
