The prosecutor's appeal is dismissed.
Reasons
1. The summary of the grounds for appeal filed the instant report with the purport that the Defendant, F, and E committed a crime of destroying and damaging property or interfering with business as stated in the facts charged, and made a statement of damage.
However, in light of the fact that each of the instant crimes was committed on one’s own, and that the F was not involved in the instant crime, while the Defendant and its employees, each of the statements made by L, H, and N is difficult to believe because it was not consistent, and in light of the fact that E, at the time of the towing of a towing vehicle, made several calls by the F, and the “the result of the winter analysis,” the F was not at the site, and the Defendant, L, H, H, J, and N made a statement to the effect that each of the instant reports was different from the facts, the Defendant clearly recognizes and reported the falsity of the instant report.
Nevertheless, the judgment of the court below which acquitted the charged facts of this case is erroneous by misunderstanding the facts and affecting the conclusion of the judgment.
