피고인은 2015. 8. 29. 10:00경 창원시 의창구 D에 있는 위 C에서, 허리가 아파서 찾아온 손님인 피해자 E(여, 45세)으로 하여금 그곳 침대 위에 눕게 하고 손으로 피해자의 허리 부분 등을 정상적으로 마사지하던 중 갑자기 욕정이 생겨, 피해자에게 “여자들은 어혈 등을 제대로 풀어주지 않으면 유방암이 걸린다”라고 말을 하면서 피해자의 가슴 브래지어 속으로 손을 집어넣어 손가락으로 피해자의 유두를 잡는 등 가슴을 만지고, 계속하여 피해자의 치마 속으로 손을 집어넣어 피해자의 허벅지와 사타구니를 만지다가 손가락을 피해자의 질 속으로 집어넣고 혀로 피해자의 가슴을 핥았다.
