The sentence of punishment against the Defendants shall be suspended separately.

Punishment of the crime

Defendant

B is the chairman of the D Association (hereinafter “instant Association”); Defendant A is the managing director of the instant Association; Defendant C is the sports director of the instant Association.

Although the Defendants did not hold the G Games (hereinafter referred to as the “instant G Games”) or the H Games (hereinafter referred to as the “instant H Games”) to which local subsidies were separately granted while holding the F Games (hereinafter referred to as the “instant F Games”) from April 1, 2017 to June 18, 2017, with the support of KRW 32 million, the Defendants were willing to receive local subsidies as if they were holding the instant G Games and the instant H Games.

1. On May 4, 2017, the Defendants conspired to provide false subsidies to hold the instant G Games in the office of the instant Association located in Jeju Special Self-Governing Province as of May 20, 2017, from May 20 to May 28, 2017, and filed a false application for the provision of subsidies to the effect that the instant G Games are held with the Jeju Special Self-Governing Province Sports Promotion Department. On May 19, 2017, the Defendants received local subsidies by receiving four million won local subsidies from the victim from the Jeju Special Self-Governing Province by fraudulent or other unlawful means, and simultaneously received property by deceiving the said victim.

2. On May 4, 2017, the Defendants conspired to provide false subsidies to hold the instant H Games to the Jeju Special Self-Governing Province Sports Association from June 3, 2017 to June 25, 2017 at the office of the instant Association in Jeju-si, Jeju-si, the Defendants received local subsidies by deceiving the said victim and receiving property by deceiving him/her.
