A defendant shall be punished by imprisonment for not more than ten months.

The application for compensation order of this case shall be dismissed.

Punishment of the crime

1. On April 16, 2013, the Defendant posted a notice to the effect that “F, a trading site of used goods on the Internet, sells middle and smartphone 2 No. 348,000 won in a gallon 348,00 won as if he/she sold gallon 2 to the victim G who reported and contacted the above notice to the effect that he/she had access to “F” website and sold gallon gallon 2” on the bulletin board. The Defendant received 348,000 won from the victim’s new bank account in the name of the Defendant on the same day.

From April 16, 2013 to May 24, 2013, the Defendant, as described in the attached Table 1, deceiving victims by the same method more than ten times in total, as shown in the attached Table 1, and acquired them by remittance.

2. At around 21:55, May 18, 2013, the Defendant sent a false Kakao Kakao Stockholm message to the effect that “If you send KRW 2.50,000,000,000 to the victim H, you will send an article,” written on the cell phone f bulletin board, stating that “Abide 2.2,50,000 won” would be read as “I will send an article if you send an article.”

However, as the defendant did not possess a par value 2 product, even if he received the price from the victim, he did not have the intention or ability to send the par value 2 to the victim.

The Defendant received 247,00 won from the victim to the post office account under the name of the Defendant in the same day.

In addition, from June 5, 2012 to June 20, 2013, the Defendant deceiving victims by the same method eight times in total, as shown in attached Table 2, and acquired them by deceiving them by remittance.

3. On May 18, 2013, the Defendant posted a letter on May 18, 2013, 2013, stating that the victim I want to purchase a mobile phone on the Internet NAVF bulletin board, and the victim “in-house Samsung Tgal just just 1 mobile phone.”
