1. The Defendant’s ground for termination of title trust as of May 14, 2014 regarding the land indicated in the separate sheet to the Plaintiff.

1. Facts of recognition;

A. Since October 1975, C owned D 2,711 square meters, and on May 26, 1995, C entered into a sales contract with E to sell 1,322/200 of the above land at KRW 100 million (hereinafter “instant sales contract”), and completed the registration of ownership transfer for E on May 26, 1995 with respect to 1,322/2,00 of the above land.

B. After that, on June 19, 1995, the land D 2,711 square meters in the division of the jointly-owned property was divided into D 1,389 square meters, F 1,322 square meters. At the same time, E completed the registration of ownership transfer solely with respect to the above F 1,322 square meters (hereinafter the above F F 1,32 square meters “B before division”). On September 29, 1995, the Plaintiff completed the registration of provisional disposition with respect to the F 32 square meters in the possession of E as the right to claim the registration of ownership transfer as the right to preserve.

C. Meanwhile, on July 24, 1996, G received the decision of provisional seizure of claims against the Plaintiff’s right to claim ownership transfer registration of F land F before subdivision (U.S. District Court 96Kadan4873), and the said decision was notified to E around that time.

E entered into an agreement on July 11, 1995 with the Agricultural Cooperative (Seoul AFF AFF) for a loan of KRW 40 million (Account Number: H), and the principal and interest of KRW 17 million on December 5, 1997, and the principal and interest of KRW 17 million were paid in full.

E. Meanwhile, the Defendant, who is the husband of the Plaintiff, obtained land transaction permission from the subordinate market on January 28, 1997 and completed the registration of ownership transfer on the ground of sale and purchase as of January 29, 1997, as to the 661/1,322 shares of FF land before division on February 12, 1997. The Defendant completed the registration of ownership transfer on April 24, 1997.

The provisional disposition registration of the prohibition of disposal stated in the subsection was cancelled.

F. After the subdivision, F land was divided into F-si F-si on October 18, 1997, F-61 square meters (hereinafter “F-land after subdivision”) and the land indicated in the attached Form (hereinafter “instant land”) respectively, and E in relation to F-land after subdivision, and as to the instant land, the Defendant alone.
