On April 22, 2011, the Plaintiff entered into a sales contract with the Defendant to purchase from the Defendant for KRW 290 million (hereinafter “instant sales contract”) the share of KRW 50/165, out of KRW 165,000,000,000,000,000 for C orchard 830,000 square meters of the said D orchard, and KRW 165,000,000,000,000 of KRW 97,000,000,000,000,000,000,000,000,000

(On the other hand, the land category of C was changed to a road, while the land category of D was changed to a road. (hereinafter referred to as “instant land”). (B)

On the other hand, at the time of the conclusion of the instant sales contract, the owners of lands around the object of the instant sales contract, including the Defendant, continued to open access roads.

C. On June 22, 2011, the Plaintiff completed the registration of ownership transfer on the subject matter of the instant sales contract, and newly constructed a child house on the land C.

In order to supply water to children's houses newly built by the plaintiff, water supply and sewerage should be installed. The construction cost of water supply is 48,733,320 won, the construction cost of sewerage is 13,270,000 won, and the development cost of groundwater will be 7,00,000 won.

2. Judgment on the plaintiff's assertion

A. The plaintiff asserted that the plaintiff purchased the land of this case in order to use it as access roads to the land of this case while entering into the sales contract of this case for the management of the children's house, and agreed to undertake road packing construction including the water supply and drainage system for the defendant to connect the land of this case, but did not perform the water supply and drainage construction. Thus, the defendant did not perform the water supply and drainage construction work. Thus, the defendant's construction cost of 69,003,320 won = 48,73,320 won for the cost of water supply construction for the children's house = 13
