Punishment of the crime

Where a business operator operates emission facilities while operating emission facilities and preventive facilities, he/she shall not operate preventive facilities or shall not conduct an act of emitting pollutants emitted from emission facilities, mixing with the air, in order to lower the degree of pollution.

Nevertheless, around March 15, 2016, the Defendant operated one string of 405 cubic meters of the painting facility, which is an air pollutant emission facility, at the place of business located in B, at the time of chemicalization run by the Defendant on March 15, 2016, and failed to operate preventive facilities in such a way as to let air pollutants emitted without passing through active carbon, because active carbon within 500 cubic meters of the facility is not properly loaded.
