A defendant shall be punished by imprisonment for two years.

Punishment of the crime

[Criminal Power] On June 30, 2016, the Defendant was sentenced to ten months of imprisonment for fraud at the Suwon District Court, and the judgment became final and conclusive on November 29, 2016.

[Specific Crime] 1. 1. The Defendant: (a) on September 2015, 2015, on the ground that the victim C was a tenant in Gwangju City D, 303, in which the victim C had one room monthly; (b) he/she had a sexual intercourse with himself/herself as a woman of substantial divorce; and (c) he/she was willing to acquire money from the victim through crypting the victim’s house; (d) around October 22, 2015, he/she sold money to the victim in Gwangju-do and Jeju-do; and (e) disposed of money to take over cosmetic; and (e) he/she would use money to take over cosmetic; and (e) received money from the victim during the period from March 201 to March 25, 2016, including transfer of money from the victim to the Defendant’s account under the name of the National Bank of Korea, i.e., taking over KRW 1,100,000 from the victim’s seat to the Defendant’s account.

However, in fact, the Defendant did not own a tenement house or building in Gwangju-si and Jeju-do, so it did not have any intent or ability to repay the money borrowed from the victim, and it was intended to use the money as personal living expenses, such as shopping, even if he borrowed money under the pretext of taking over the beauty room.

Accordingly, the Defendant, by deceiving the victim as above, received 35.5 million won from the victim and acquired it by fraud.

2. On December 17, 2012, the Defendant of “2016 Highest 6141” is the land in the volume of 890 square meters in Gyeyang-gu, Incheon-gu, the victim G from the “F” page located in Suwon-si, Suwon-si E.
