The defendant shall be innocent.

1. The summary of the facts charged is that the Defendant is the representative director of the Co., Ltd. (hereinafter “the instant education center”) who actually operated the said education center. The Defendant made a false statement to the effect that the Defendant would not have any problem with the payment of meal costs and the return of deposit money to the victim even if he received the deposit from the victim D and concluded a contract for the supply of entrusted meals with the said education center, and even if he did not have any intent or ability to pay the meal cost or return the deposit. On November 27, 2009, the Defendant acquired the money by receiving KRW 30 million from the victim from December 1, 2009 to November 30, 2010, and acquired the money from the victim for one year (hereinafter “instant contract”) and acquired the money from the victim for the purpose of the deposit on December 30, 2009 to September 16, 2010.

2. The following facts are acknowledged according to the evidence of this case.

① The instant Educational Institute is a juristic person conducting workplace skill development training after being allocated training personnel by government agencies, such as the Ministry of Employment and Labor, the Small and Medium Business Administration, and the Human Resources Development Service of Korea. Since its establishment on July 2006, the pertinent Educational Institute was a structure that pays profits after receiving ex post payment of vocational training expenses and meal expenses from the above Ministry of Employment and Labor. Since its establishment on July 2007, 2006, the amount of KRW 935 million was KRW 95 million in the year 2007, KRW 1.65 billion in the year 2008, KRW 2.186 million in the year 2009, and was converted into black for the year 2009.

② G Co., Ltd. (hereinafter referred to as “G”) which is a meal service company operated by E and F couples (hereinafter referred to as “G”) shall enter into a contract for the supply of meal services with the instant education center, which newly launched the provision of meals for early childhood training in 2007, and shall pay KRW 150 million to the education center, and provide meals to trainees of the education center.
