1. The Defendant acquired by prescription on March 7, 1999 with respect to the Plaintiff’s 480 square meters prior to Gangseo-gun, Hongcheon-gun.
Reasons
1. Facts of recognition;
A. On January 1, 200, the Korea Agricultural and Rural Infrastructure Corporation comprehensively succeeded to the rights and obligations of the Hongcheon Farmland Improvement Association, and thereafter, the name of the Korea Agricultural and Rural Community Corporation and the Korea Agricultural and Rural Community Corporation were changed to the Plaintiff.
B. On June 12, 197, Gangnam-gun, Hongcheon-gun, Seoul was divided into 950 square meters prior to C (the unit is converted into 3,140 square meters thereafter) and 247 square meters prior to B (the unit is converted into 817 square meters thereafter; hereinafter “instant land”).
C. On December 18, 1978, Hongcheon Farmland Improvement Cooperatives implemented E agricultural water development projects in Hongcheon-gun, Hongcheon-gun, Hongcheon-gun, 197, incorporated the said land into a facility site (water reservoir’s bank and secondary road) and purchased the said land from F, the owner at the time of December 18, 1978.
The Red Farmland Improvement Cooperatives established a reservoir which is an agricultural infrastructure and a road, irrigation channel, etc. to manage such reservoir around March 7, 1979 and installed the above land from F around March 7, 1979 and connected each point of the attached Form 1, 18, 11, 12, 13, 14, 15, 16, 17, and 17, among the land of this case, “A” portion of 184 square meters connected in order to each point of the above 2,3,20,20, 21, 9, 10, 19, 18, and 11, 12, 13, 14, 15, 16, 17, and 184 square meters in line with the above road; the portion of “A” portion connected to the above 81 square meters in line with the above road; and the portion of “A” portion of 29 square meters in line with each of the above 29 square meters in line.
E. On February 23, 1979, the Hongcheon Farmland Improvement Cooperatives completed the registration of ownership transfer with respect to three thousand square meters prior to C,140 square meters, and on October 5, 1987, the land category was changed to the maintenance of land category.
F. F. The Defendant died in around 1988.
