A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
[2014 Highest 2848] The Defendant: (a) transferred a house and the PC room in Ansan-si; (b) transferred the house and the PC room in order to raise the living expenses and entertainment expenses to the mixed life; (c) returned to the restaurant around the restaurant in Ansan-si; and (d) colored the subject.
1. On October 4, 2014, the Defendant: (a) around 02:00, at the time of Ansan-si, the victim D (hereinafter “E”); and (b) the victim, after completing the restaurant business, went into the restaurant with a stone with a stone stud; (c) attempted to steal money in the restaurant, but did not have money to the depository; (d) the Defendant did not commit an attempted larceny; (c) the Defendant invaded on the restaurant more than four occasions from October 4, 2014 to November 7, 2014, and stolen money and stolen money, as indicated in the attached list of crimes (1).
Accordingly, the defendant attempted to steals the victims' property by destroying a part of the structure at night and impairing the structure, but attempted to do so.
2. From October 22, 2014 to November 8, 2014, the Defendant: (a) fell under “H restaurant” operated by the victim G located in Ansan-si, Seoul-si, a member G; (b) and (c) cut off cash of KRW 100,00 from a credit cooperative located at the same place by taking advantage of the gapss that the said victim did not have returned home after running a restaurant business; and (d) cut off a mobile phone of KRW 1,567,000 from October 22, 2014 to November 8, 2014; and (b) intruded into a restaurant at night on more than 12 occasions, such as the list of crimes in the attached Form (2).
Accordingly, the defendant invadedd a structure at night and stolen the victims' property.
3. On October 24, 2014, the Defendant who attempted to larceny at night buildings was at a cafeteria operated by the victim J, located in Ansan-si, a member-gu, Ansan-si around 03:00, and the said victim was at the cafeteria.
