A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On January 5, 2007, the Defendant was sentenced to a fine of two million won for a violation of the Road Traffic Act (driving) at the Seoul Central District Court on April 11, 2007, a fine of five million won for a violation of the Road Traffic Act (driving) and a fine of two million won for a violation of the Road Traffic Act (driving) at the same court on May 20, 2009, respectively.

On October 27, 2014, around 15:05, the Defendant driven CK5 vehicle under the influence of alcohol by 0.232% from the section of approximately 40km from the 15:00-ro, Seongbuk-gu, Seoul to the 526-ro, Hancheon-ro, Seongbuk-gu.

As a result, the Defendant driven a motor vehicle under the influence of alcohol even though the power of driving a motor vehicle is twice or more but under the influence of alcohol.

2. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Death or Injury caused by Dangerous Driving) was driven by the said vehicle as a temporary border as above, and the Defendant changed the course to three-lanes while driving the said vehicle in front of the 526 Gyeongcheon-ro, Seongbuk-ro, Seoul, Hancheon-ro, Hancheon-ro, Seoul, and changing the two-lanes of the two-lanes of the two-lanes

At the same time, the victim D(26 years old) driver's NFIS car stops in the signal atmosphere, so in such a case, the driver of the motor vehicle has a duty of care to look at the front door well and to prevent the accident by accurately manipulating the steering gear and the brake system.

Nevertheless, under the influence of alcohol, the Defendant neglected to do so and received the back part of the above NFIS and other automobiles standing in the signal atmosphere as part of the Defendant’s passenger vehicle.

After all, the defendant is driving a motor vehicle in a situation where normal driving is difficult due to influence of drinking, and the defendant needs approximately three weeks of medical treatment to the victim.
