Purport of claim and appeal

1. Summary of both parties' arguments;

A. The gist of the Plaintiff’s assertion was: (a) the Plaintiff worked as a tree of the Gangseo-gun C&S (hereinafter “Iron”) operated by the Defendant, Sungnam-si D&S (hereinafter “S”) and the Seongdong-gu Seoul Seongdong-gu Ground Office Work (hereinafter “E”) on the part of the Defendant; (b) KRW 2,660,000, out of the wages of the steel origin construction x 22,660,000, out of the wages of the steel origin construction x 11,000,000, out of the wages of the Seongdong-gu Corporation 11,000,000, and KRW 53,820,000,000 (daily wage of KRW 230,000 x 234 days x 234 days x 1,820,000,000 won for the part of the machinery construction x 500,000 won for the agreed period of x 2005,0050.

Therefore, the Defendant is obligated to pay to the Plaintiff the total amount of KRW 17,530,00 (=2,660,000 KRW 1,820,000 KRW 1,820,000 KRW 6,050,000) and damages for delay.

B. The gist of the Defendant’s assertion was that the Defendant paid the Plaintiff KRW 2,660,00,00, out of KRW 22,600,000 of the wages of the Steel Corporation and KRW 11,000,000 of the wages of the Sungnam Corporation, and KRW 11,000,000 of the wages of the Sungnam Corporation, but the wages of the E Corporation are KRW 47,610,000 (=230,000 per day x 207 days per day x 207). Since then, the Defendant paid KRW 52,00,00 to the Plaintiff, the Defendant did not agree to pay the Plaintiff the unpaid wages of the said steel Corporation and Sungnam Corporation and KRW 3,660,00 of the unpaid wages of the E Corporation and KRW 47,610,000,000 for the machinery, tools or supplementary materials.

2. In the judgment, the defendant paid 20,000,000 won out of the wages of 22,660,000 won of the iron capital, and 10,000,000 won out of the wages of 11,00,000,000 won of the Sungnam Corporation, and the unpaid wage that the defendant has to pay to the plaintiff shall be paid to the plaintiff.
